1. Purpose and Acceptance
These General Terms and Conditions of Sale (T&C) govern the contractual relationship between and the customer, who fully accepts these conditions by placing an order through our website.
2. Order Process and Customization
- Custom Orders: Orders for personalized cakes are subject to our approval of the design and final price.
- Artisanal Nature: Because our products are handmade, variations in the final result may exist, and exact replicas of designs are not guaranteed, especially if based on photographs from other pastry chefs or AI-generated images.
3. Allergens and Liability
Our products may contain or have come into contact with common allergens such as milk, wheat, nuts, and soy. The customer accepts the responsibility to notify their guests of this risk and releases from any liability for allergic reactions.
4. Prices and Payments
- Prices: All prices are in CHF and include VAT if the company is obliged to charge it.
- Payment: To start the production of an order, a non-refundable deposit or the full 100% payment is required. The product will not be delivered until full payment has been received.
5. Cancellations and Changes
- Cancellation Policy: Cancellations must be made at least [Number] business days in advance. If canceled outside this period, the customer is responsible for the full payment of the order.
- Changes: Once the order is confirmed, changes to the model, flavour, or delivery date are not accepted unless notified in writing with sufficient notice.
6. Returns and Deliveries
- Right of Withdrawal: In accordance with Swiss law, the 14-day right of withdrawal does not apply to products manufactured according to customer specifications or those that may perish quickly. Therefore, returns of personalized cakes are not accepted.
- Responsibility: Once the cake has been delivered or collected, the customer is solely responsible for its handling and transport. We are not responsible for damages that may occur after delivery. No refunds will be granted for products that have been consumed, as consumption is considered an acceptance that the product is fit for consumption.
7. Applicable Law and Jurisdiction
These T&C are governed by Swiss law. Any dispute will be submitted to the courts in in Switzerland.
